My father passed away last 2001 and no written contract were signed. anyway nun sinakop nila yun daan nabawasan yun gate namin, until nakabili ako ng second hand car and I have to park it inside our garage however dahil sobrang lumiiit n yun opening ng gate namin, palagi n lang s may bangketa na k park at di ko naman mapalagyan ng bubong dun.
I approached po yun president ng homeowners namin however di n daw po nila sakop yun at ni refer po ako s City Hall Engineering office, tumawag po ako s engineering office at pi nag su submit po kami ng letter to survey the land. We can send the letter next week, however ito po ang mga tanong ko:
1. Meron p b prescription period s mga right of way, kasi po dati di naman po naman kailangan kaya lumipas na ang mga 15 years bago talagang gusto namin mabawi ang tamang right of way s street naman n dead end at lumaki ang space or opening ng gate namin.
2. Second question po, pwede po ba na hintayin namin ang decision ng engineering office ng city hall and ask them to abolish the extension, or kailangan mag file p kami ng case et al?
3. Ano po ba ang sakop ng city hall pagdating s right of way ng private subdivision, sila po ba ang may full authority to decide and issue a court order.
