hi Atty.. i work in a call center, i was injured at my office.. during my lunch while was venting out from a bad call a marble piece ( the size of a half a standard sized bed) fell on my left foot in the ladies washroom.. i got hospitalized (admitted) and operated that resulted to me going on leave for about 10 days now.. my company helped me with the hospitalization but refused to pay the days i missed as per their policy.. (they keep saying i should complain to SM as it is their facilities). I couldn't understand if this would be ok to accept since what i was thinking is that they would be the one filing complaint to SM facilities and that i am their responsibility for i wouldn't be missing work if it weren't for that accident that actually happened while i am at work.. as per SSS claim they said they would only provide 400+php per day and that's not even half of my rate.. I'm really lost and I'm not familiar with labor law,, please kindly advise.. thank you very much and more power..

Write a letter to your HR asking for compensation, if they refused bring the matter to DOLE for you to file SENA, it is a small claim form,Afterwards mediation process will take place where you and your company will met together with DOLE representative.

imo, the company is not doing anything wrong. this is why sss exists, to give a quick and sure resolution to employee injuries, thus freeing the employer from the obligation and the employee from having to file a case just to claim.

in addition to the sss, you can also inquire at the employee compensation commission if you can claim additional benefits.

it is not your company but you who has the right to claim from the facility owner.
