i got married po ng dec 8, 2000 at sa manila po ngwowork husband ko at ako sa probinsya...after po ng kasal lumuwas na sya ng manila to work then hindi na po sya angpakita ulit sa akin after that...text na lang po nareceived ko na ayaw na daw nya..bago po kasi ang kasal nagsama kami ng 1 year and 6 months...may nakilala po daw sya na babae at dapat daw hindi na lang kami nagpakasal...nun jan 9, 2001 nagkita po kami ulit at pormal na naghiwalay matapos po ang sampung buwan nagkita kami ulit para pagusapan ang annulment...ayaw po nyang ifile ang case na sya ang lalabas na may problema...hindi po kami nagkaayos sa reason for annulment....after ng huli naming pagkikita at paguusap wala na po kami communication...ano po pwede ko gawing dahilan para mapawalang bisa ang kasal namin? may boyfriend na po kasi ako at gusto na naman pakasal at maging legal bago kami magkaanak?...sana po matulungan nyo ako...salamat po

before we talk about pscycho incapacity, did you acquire a marriage license together at city hall? where were you married? how old were you?

we got marriage license together...civil wedding and i am 23 and he is 22...with parent consent...

is there a way for you to find out if he is still alive? you can explore the possibility of filing a petition for declaration of presumptive death of your husband if there has been no communication for at least 4 years.

if granted, you can validly get married. however, if your husband reappears and files an affidavit that he is alive then your marriage will be dissolved.

your other recourse is to file a petition for annulment based on psycho incapacity.

yun nga din iniisip ko to declare him death....pero baka nga biglang umappear...if ill fiule annulment mga ilang taon ang process? since 10 years almost na kami hiwalay mas mabilis na ba?

legally, length of time of separation is not a factor in determining psychological incapacity. judges, however, are sometimes more sympathetic because of a long time of absence.

i'd go with the presumptive death. if he reappears, he has to file an affidavit with the civil register in order that your marriage is dissolved. so even if he reappears but he does not file that affidavit, your second marriage will remain valid.

i would advise against annulment on the basis of psycho incapacity. if you allege it is your husband who is incapacitated, the doctor will not be able to examine him. unless it's ok with you that you're the one who is declared psychologically incapacitated. it won't keep you from marrying again.

presumptive death can be done in 1-3 months. annulment 1-3 years.

you can use that ground only until you are 26 years old. is there still time?
