good evening po gusto ko po sana magtanong kung anu ang dapat naming gawin ninakaw po ng ama ko ang titulo ng bahay at lupa ko pero di pa naililipat sa pangalan ko adahil kabibili ko lng nito....ang masama pa po parang ibinigay nya ito sa pinagkaka utangan nya ,,,anu po dapat kong gawin pwede ko po ba idemanda yung pinagsanglaan ngama ko kung ayaw nyang ibigay ang titulo dahil nakaw ang titulong hawak niya,,,,,,,,,,,sana po masagot nyu agad tnx

you cannot file a criminal case. your father is exempt from criminal liability. under the revised penal code:

ART. 332. Persons exempt from criminal liability. – No criminal, but only civil liability shall result from the commission of the crime of theft, swindling, or malicious mischief committed or caused mutually by the following persons:

1. Spouses, ascendants and descendants, or relatives by affinity in the same line;

2. The widowed spouse with respect to the property which belonged to the deceased spouse before the same shall have passed into the possession of another; and

3. Brothers and sisters and brothers-in-law and sisters-

in-law, if living together.

The exemption established by this article shall not be applicable to strangers participating in the commission of the crime.

There is also no absolute divorce in the Philippines. However, your mother does need the law to move out and live elsewhere. you can also try to convince him to move out of the house, but you cannot force him.

who is the registered name on the title? is the property fully paid for? do you have a deed of sale? you can file a civil case to compel the person holding the title to give it back. you can also file a case for civil damages against the person holding the title and/or your father.

start with a letter to the holder of the title demanding him to return it.

thank you verry much for ansering my question ,,ipagpapatuloy ko po ang kuwento ko,,,,bayad na po yung buong bahay pero wala pa sa pangalan ko,,meron po kaming deed of sale,,ngyun po nagpapagawa na po kami ng bagong titulo,,,pano po ang gagawin ko at sasabihin pag lumitaw ang may hawak ng nawawalang titulo ???plss teach me what to do.... ...at magkanu po ba nagagastos kapag nagpapalipat ng pangalan kc po nagtanung kami minsan ang sabi po 100 thousand daw po ,,parang ang mahal naman yata kc ililipat lng naman po sa pangalan nmin yung titulo...

and one prob pa po yung pinagbilan namin ng bahay ang sabi babayadan nila ang amilyar noong 2008-2009 pero chi neck po nmin ang sabi ng staff di pa daw po sila bayad ngyun hnanap nmi sila ang sbi nga bayad na daw sila pero wala po silang maipakitang resibo???????????panu po kaya yun tnx...im hoping and requesting a tagalog answer tnx

re-issuance of a new owner's duplicate of title requires a petition in court. don't you know who has possession of the title? didn't your father tell you who he gave it to?

your proper recourse is to file a case to compel the possessor of the title to return the title. please be careful in your allegations in a petition for reissuance. if you are caught stating a falsehood, you can be made liable for perjury.

tax depends on the value of the property. normally the taxes will be 8.5% of the value of the property. didn't you agree with the seller that they should shoulder capital gains tax of 6%? yes, penaties may apply if you did not immediately pay the documentary stamp tax which is payable within the next month after the deed of sale is executed.

do you have a written agreement that they did not pay for real estate tax (amelyar)? ask for a certification or assessment at the assessor's office so you can show them that it was not paid.

you should also consider annotating an affidavit of adverse claim on the title at the register of deeds. otherwise, someone may pretend to be the registered owner and sell it again to an innocent purchaser.

for the taxes without including penalties, multiply .085 X Selling Price. this should give you a close estimate of the taxes.

he who claims payment has the burden of proving it. as i said, get an assessment from the assessor's office so you can show the previous owner.

thank you verry much,,,,,,sa pagpapalipat po ba ng pangalan magkanu po ba ang karaniwang binabayad sa attorney na kukunin namin,,,,,at yung lua po nmin ay 209 sqm so ibig svhin po ita tyms ko yun sa 0.85 ang bili po nmin sa bahay ay 950thou,,,,yung kalalabasan po ba nun ang bayarin sa bir? yung isa ko pong kasamahan ang sabi po kpag daw po bnayadan yng 2 years ng buo magkaka discount daw po ba ng 70percent??????????/tnx

i approximate the costs of transfer to be about P80,750 plus penalties if applicable (0.085 x P950k). have your taxes assessed at BIR so you won't be fooled. don't talk to fixers.

please check your deed of sale if it mentions who pays the tax. normally capital gains tax of 6% is paid by the seller. the other 2.5% for doc stamps and transfer and registration fees is for the buyer.

i believe your friend is referring to annual real estate tax.

good evening po ....ask ko lang po nababahala na po kc me tlaga,,,,yung isa pong titulo na nasa registry of deeds natatakan na po ng lost,,,, ngayun po inaayos na ng nanay ang lahat lahat para makapagpagawa na ng bagong titulo,,,kapag po lumitaw yung may hawak ng titulo at ipapatubos sa amin ng mahal hindi na po nmin kukunin yon kc nagpapagawa na kami ng bago,,,naghanap nman po kami kaso walang lumilitaw ng may hawak na titulo..just in case na mag demanda sya sabi po ng attorney namin wala na daw pong laban yung taong may hawak ng nawawalang titulo..totoo po ba yun?

may deed of seel po kami....affidavith of lost,,,,at nagreport na rin po kmi ng lost of the title....and2 po kc me sa japan kaya wala pa po akong magaw hinihintay ko pa po matapos ang hering para diretso na sa pangalan ko ang bagong titulo pag nagawa na..tnx
