Arresto Menor

Magandang araw po. Nawa'y matulungan niyo po ako sa aking problema.

May lupang naiwan ang father ko sa aming apat (4) na magkakapatid. Ngunit nalaman na lang naming naibenta na ang lupa gayong isa lamang ang pumirma sa aming apat (4) na magkakapatid. Ang kapatid kong ito ay wala namang titulong nakapangalan sa kanya dahil wala pa namang LEGAL PARTITION na nagaganap noong ibinenta nia ang lupa. Ang mga tanong ko po ay:
1. Ilegal po ba ang pagkakabenta ng lupa at maaari pa ba naming bawiin ngayon itong lupang naibenta ng isa lamang naming kapatid?
2. Kami ba ay may karapatan pang bawiin ngayon ang lupang ito gayong patay na ang aking kapatid na nagbenta at patay na rin ang mag-asawang bumili ng lupang ito at naigawa na rin ng titulo ang lupang ito sa pangalan ng mga anak ng mag-asawang bumili?

P.S. Naigawan ng titulo ang nasabing lupa noong Septyembre3 22, 2004.

yes you can still try to go after your share in the property, but if this has been more than ten years, the court may rule against you because you delayed and did not watch over your rights. how many years since your parents died?

it appears that the property has already been transferred twice, first by your brother to the buyer, and then transferred to the children of the buyer.

go to the register of deeds to check on the history of the titles and the documents used to transfer the titles. if your brother falsified a deed of sale, making it appear that your parents were still alive and sold the property, AND the property was transferred by the buyer through donation then you may still have a chance.

If it was transferred to the children of the buyer through sale, you will have to prove that they did not really buy the property or that they were aware that your brother had no right to sell the property.

the legal principle here is that a falsified deed of sale transfers no rights, BUT if the property has been transferred to an innocent purchaser for value, then the law will protect the innocent purchaser.
