Atty, ano pong difference if ang titulo ng lupa ay stated like this "Juana married to Juan" at "spouses Juana and Juan" as owners. If namatay yong isang spouse, sino po ang may karapatan sa lupa sa dalawang sitwasyon? Naguguluhan po kasi ako. Salamat po sa advice. Laughing

Hi, depende sa Property Relations nang mag-asawa, kung Absolute Community of Marriage, regardless kung "Married to..." at "Spouses..." parehas na property nang mag-asawa yan, PERO kung Complete Separation of Property, ang "married to..." ay pag-aari nang principal buyer... kung "spouses..." pag-aaari nang both spouses. FYI, kung walang agreement as to Property Relations ang mag-asawa at kinasal after 1987, ang automatic/default property relation ay Absolute Community of Marriage.

pwede ko po bang itransfer sa ownership ang land title nming mag asawa sa 3 anak nmin?13,17 at 23 yrs old n po ang mga anak namin.sa ngaun po 5 months na akong nagbabayad sa housing loan nmin sa bank..ung pong land title ay nasa developer pa po..salamat po sa kasagutan..

The effectivity of the Family Code is August 3, 1988

The bank and the developer might not agree to this arrangement, and even if they will, since you are married, you will need the consent of your husband to whatever deed of donation or waiver you are going to execute in favor of your children.

The best thing to do is to contact a relative in the Philippines, send them an SPA to find a lawyer for you and file a petition for legal separation or complete separation of property against your husband so that he will have no financial interest in all your efforts.
