Magandang araw po. Gusto ko lang po sana hingan yung legal advice nyo regarding sa housing loan. Kumuha po ako ng isang townhouse at nabayaran kona po ng full ung 20% ng total contract price as of January 2012. But as of December 2011 palang sinubukan ko pong i aaply na ng loan sa bank ung magiging 80% na remaining balance, kumpleto napo ako sa lahat ng requirements except sa TCT copy na hindi pa maibigay ng contractor/owner kaya hindi rin ma iprocess ng bank ung application. Ang sabi po sakin ng contractor/owner habang inaantay raw po ma release yung TCT copy nirerequire daw po nila na magbayad kami ng 30k monthly amortization at once na marelease ung TCT at ma approved na ung loan e irerefund nila ung sobra kung meron. To cut it short po by May 2012 lang nila naibigay samin yung copy ng TCT kaya June palang po na start i process ng bank yung loan application. By July 2012 po namin nareceived yung approval amounting to 100% ng total remaining balance. Two months lang po ako nkpgbayad ng amortization sa owner which is for the month of Feb and March at ngayon po ung owner/contractor imbes na bigyan kami ng refund para dun sa 2 months na hinulog namin e pinagbabayd pa kami ng equity para sa penalty at interest from April-June which is 21% per annum apart pa ung interest na kinuha or chinarge nila for the first 2 months na binayad ko sa amortization. Gusto ko lang po sana malaman kung legal po ba yung procedure na ginawa nila at interest rate na chinarge samin considering walang written notification about sa mga charges at yung cause ng delay for approval e nanggaling sa side nila. My possibility po ba na mkahingi kami ng refund or atleast deductions man lang sa interest or dapat po ba namin talagang bayaran yung equity na pinapabayaran nila. Pano po ba mg file ng deduction or refund if ever. Thank you so much!

Sa Developer po ako kumuha ng unit then ang terms po na binigay nila is 8 months to pay ang 20% DP then tru bank loan or pag ibig naman po yung option na binigay nila samin for the remaining 80% balance.

Tingan mo kung nasa contract yung sinasabi nila and kung ung buong 80% ng balance mo is kinuha ni bank wala ka ng dapat pang bayaran sakanila in fact may refund kapa dapat (exclude their interest) ahente kasi ako ng bahay and nag proprocess din ako sa bank

Ganyan ang tama kung ipipilit nila ung pag babayad mo ng another w/ interest at di sila mag bibigay sayo ng refund file a complain in HLURB

May i asked sinong developer yan ?

Good day, gusto ko lang po hingin ang opinion nyo regarding s housing loan namin. Kumuha po kmi ng Mr. ko ng house and lot sa isang subdivision nung july 2009, fully paid kmi ng august 2009 ng equity at yung po remaining bal. na 80% ay thru pag-ibig(30yrs). pero magpahangang ngaun ay sa developer pa rin kmi nagbabayad ng amortization ng bahay 3 years n po ngaun aug. pagnag fallow-up po kmi lagi ang sabi hindi pa raw po naaapprove ng pag-ibig hangang nung may 2012 pinatawag kmi para po pirmahan uli ung bago requirements para sa pag-ibig kasi daw po nag lapse na. yung po 836k na loanable namin s pag ibig w/ monthly kmi 7,171.27(3yrs) n tuloy tuloy na hulog ay naging 817k n lng po. at nito nga po aug. 25 nag seminar po uli ang mr. ko para s pag ibig at dala n rin po nya ung notice of approval at nakita ko s letter ung loanable amount nya ay naging 829k. may makuha po ba kmi refund s developer sa loob ng 3yrs nmin pagbabayad sa knila ganon 7k lng po ung nabawas dun sa 836k n bal? at pano po computation nila s refund? salamat po..
