I just need some information if the law changes now.
An accident happen, collision between 2 cars, one is almost new and other car is vintage. Almost new car driven by a doctor and only scratch around side or beside the car(don't know if it's old scratch or new) with no passenger while the vintage car fell on the ditch after skidding, 3 passenger had injuries and they let the police handle and they towed the vintage car and of course the owner paid the expenses to the police department of towing expenses but they tell the injured parties to get the affidavit of undertaking in order to release the vehicle. Unfortunately, the lawyer don't want to issue an affidavit of undertaking because he want to settle first with his client(happen to be the driver of almost new car). This client and lawyer are on political aspiring in Philippines.
And as far as I know in Philippine Law, Lawyer cannot withheld the property(car)without a court order, is it? This is more than 24hours happen.
I just need to know if this was changed or had a law to hold the property.
Can you give us legal advice. How to get the vehicle and about that affidavit of undertaking.
