Can a deed of sale with assumption of mortgage notarized even if the title still in the bank????

is it the same with the absolute deed of sale once notarized you need to transfer it immediately???

with no other facts, the answer is yes, but you won't be able to transfer the title without the bank's consent

atty the bank told us that its for documentation only to be aknowledge by them that we are the new owner and will assume the balance they will attach it including other documents like spa..

i want to know since the bank will not allow us to get the title for transfer until fully paid.....if we notarized the deed of sale with assumption of mortgage is it like the same with absolute deed of sale that you need to process the transfer immediately??? or its different???
