We have an apartment and the only person that signed the lease that still lives there is our son. The other two old roommates moved out. He has two new roommates that never signed the lease. Can he have the landlord change the lock and force the nonpaying roommate out? Can he move his roommates things out of the apartment? These roommates never signed a lease or gave a security deposit.

does the lease contract allow your son to sublease the apartment?

what steps have you already taken to ask them to leave? I would try convincing them to leave rather than forcing them. suddenly changing the locks and dumping their belongings outside may make him legally liable.

if negotiating fails, i suggest that he files a complaint at the barangay and hopefully, they can reach an agreement.

Got a same problem. I said to my roommates to leave cause they are delingquent payers in the rent of a condo which i am leasing and they are trying to get their security deposit from me on the last day of our contract, but my contract to the owner will be delayed for two months, they are insisting that they are not under that contract. Now I asked them to live immidiately allowing them to take their clothes but not their valuables which they will recover after they pay me back. I did this cause their delingquencies will dim my security deposit for forfeiture from the owner. Can they file unjust vexation against me or any other case? They did leave cause the broker of the condo talked to them. But I'm afraid that they get back to me with Unjust vexation for evicting them on the same day the issue was brought out.

i don't think it's grounds for unjust vexation, but they are free to initiate any case.
