Hello po, we have a problem of my husbands last employer.My husband signed a contract for 3 years because of the training he attended, na hindi sya pwede mag resign for 3 years after the training which it has already been served because the training was on 2008 and my husband resigned this 2012 but on top of that contract, meron din pong non-compete agreement na hindi sya pwede magtrabaho sa isang competitor " direct or indirectly" for 3 years after the resignation. Matapos sya mag resign, nalaman ng previous employer that he is working in a competitor. Ang totoo po, hindi po sya empleyado doon, consultant or freelancer lang po sya doon. Pero ayaw po nilang maniwala, kaya pinadalhan nila ng lettter ang husband ko to demand on quiting on his current employer or else they will file a lawsuit against my husband for a breach of contract.

My question is:
1.) Pwede po ba sila mka file ng case against my husband samantalang hindi naman sya employee doon sa sinasabi nilang current employer daw nya?
2.) Paano po kung hindi sila makakita ng evidence like documents to prove na hindi talaga siya employed in that company?
3.) Hindi po ba't naaapakan na ang aming human rights kung hindi pwedeng magtrabaho ang husband ko for 3 years samantalang yun lang alam nyang trabaho dahil isa lang syang skilled worker for 15 years? Paano nlang po ang pamilyang pinapakain nya kung wla syang trabaho?
4.) Pwede po ba kaming mag file ng case against them for human rights?
5.) Ano po ba ang dapat namin gawin?
6.) Ano po ba ang penalties ng breach of contract?

In that contract po, parang wala nang kawala ang kanyang empleyado, habang buhay ka nang mag tatrabaho doon. Nasaan na po ang ating free will? Kung meron naman pong mas magandang opportunity sa iba? Paano na po ang pamilya nya kung hindi sya pwdeng magtrabaho for 3 years nang dahil lang sa agreement na yan? Sanay mabigyan mo po kami ng idea or kapaliwanagan kung ano po ang dapat naming gawin. moderator

i do not recommend that he resigns. a non-compete clause is indeed enforceable but you can argue that 3 years was too long, depending on the level of his position.

Dati po syang supervisor. Pero paano po yan eh nka resign na po sya? Ano po ba ang dapat namin gawin? may laban po ba kami? Ano po ba ang penalties nito?

what i would do is reply to any letter sent that we don't believe the clause is proper. the biggest deterrent is the cost of a legal remedy for the company.
