Good morning atty. Question po last week our neighbor said that two police went to our house with a warrant of arrest for me for not attending (for the first time) my May 28 hearing which is a criminal case for bounced check. The case started in 2008 with check face value of 50k and since then ive been attending court hearings and been giving partial payments to the lending representative as i cannot pay the full amount in one setting. My last hearing was May 28, unfortunately I was sick hence wasnt able to attend the said hearing. Since I dont have an attorney (represent myself on open court during hearings), I wasnt able to inform the court of my absence. Then last week when we I went home from a month long stay wt my sister's place, I was told by our neighbor next door that police came and looked for me and they have warrant of arrest for me. I would like to ask:
1. how I may be able to request for cancellation of the said warrant? The lending representative said I can if I have to pay in full the remaining balance of 11,000 plus the dismissal fee and cash bond for the warrant. Thing is I dont have yet now.
2. I just lodged my aplication for visa to Australia yesterday for a tourist visit there which is solely sponsored by my aunt. Would there be HDO against me becase I have warrant of arrest? Will the embassy knwo about this and hold it as ground for not granting the visa?
Thank you so much attorney. Looking forward to hearing from yoou.
By the way the lending representative said that the bail for my case is 2,000 pesos.
Sincerely,
Sreech
