Good day! I want to ask kung ground po ba sa annulment ung physical emotional and financial incapacity. 3 years pa lang po kami kasal and we have two kids. I was force to marry him coz im preggy. After i gave birth our oldest son naghiwalay kami dhl simula po nung kinasal kami hndi sya nagtrabaho. He never gave anything to support our family umaasa po sya sa pamilya ko at sakin. Everytime na sinasabihan ko sya na magsikap sinasabihan nya ko na mukang pera at pera lang lagi ko iniisip. I decided na paalisin sya. After a month bumalik sya i was hoping na magbabago pero gaya dn ng dti wala syang trabho at sa magulang ko pa rn naasa. Almost 2 years na po kami hiwalay. Evrytime i ask for support he makes me feel im a whore at pera lang ang gusto ko. Gusto ko na po naannul sa kanya. Mula simula ng relasyon namin hanggang ngayon never pa sya ngbigay ng suporta sa mga anak nya. Do you think may chance po na maannul ung kasal namin? I want to move on together with my kids. The fact na gamit ko pa rin last name nya hindi ako makamove on. Sana po matulungan nyo ko. Thank u.

Physical, emotional, and financial incapacity are not grounds for annulment. It only means you're unlucky to have such kind of a husband. However, if a brilliant psychologist could convert the same into psychological incapacity, then you may use that as a ground to have your marriage annulled.

Hi Mommyicay.

One ground that may be used in filing a Petition for Declaration of Nullity is psychological incapacity of either or both of the parties. This does not have to be a mental condition that needs treatment, it only means that the party/parties psychologically incapacitated is/are rendered incapable of performing the marital obligations.

If it can be shown that your husband's inability to support you physically, financially and emotionally is due to psychological incapacity, then it may be just the ground you need to file the said Petition.

Thank you. Im thinking na Magfile this year para maayos lahat ng papers namin ng mga kids ko bago umalis ng bansa. How much it will cost? And gano po katagal ang process? Saan po magsisimula ? And pano po ang process ng annulment?

Good morning Mommyicay.

In annulment proceedings, a petition is filed by the petitioner before the Regional Trial Court of the province or city where he/she has been residing for the past six months.

The duration of the annulment proceedings depends on the availability of the court where it is filed. If the court has a number of cases to hear and decide, it may take a while longer.

As to the costs, it is also on a case to case basis. It will depend on how much you will be charged by the lawyer of your choice.
