Hi I just want to ask what to do in claiming my salary or back pay.

I joined a start up company last year at around November 2011. We did not sign any contract. It was based on trust. They promised me PHP 18000 monthly salary so I resigned from job to join them. Then they gave me a share of 3% in the company which is worth PHP 6000 at that time. (We have contract signing when they gave me company shares.)

after a month they asked if its ok to give me 15000 instead. Since I worked at home and its a start up I agreed. I even agreed to PHP 10000. They paid me 4 times the amount PHP 5000 only up until December 2011. From January till April I did not receive any salary from them. But we still worked with projects until that time. I got a part time job which later turned to full time just to coup up financially.

I decided to resign last May. Every time I email them for an update for my salary they will reply that they will update me. But nothing happens up until now.

When I emailed again they said that my salary was not enough to compensate for the losses our last failed project. which is not totally my fault since I gave them a standard of 2 weeks time to finish a project, and they took a project that was due in just 1 week.

A good legal advice of what I will do to claim my unpaid salary is much appreciated. thank you.

hi. I just want to ask about the process of Putting the salary on hold.

I am only 5 months and 5 days old in this callcenter. I signed the End of probationary contract of employment just last June 14, 2012. Got terminated due to unable to meet the standard grade gridd. First question, is being terminated differ from signing End of Probationay contract? Second, Is it fair to put the salary on hold immedaitely when the salary release is only a day away? I was really expecting that my salary will be given bec its only one day before it'll be released. I went to work untill the cutoff between may 15 to 30. This cutoff is for the june 15 salary. Pls help i realy need you opinion. To me, it is so unfair that my salary was immediately put on hold. I did not do anything grave to the company. It is just so unfair. I just need to know if it is rightful to put the salary on hold and what will be my solution or your advise for me on this kind of situation. Thank you.

Hi maddy,

Termination is different from signing end of probationary employment. If your employment was terminated there should be just or authorized cause.

So until now you have not been paid for your May 15 to 30 salary? I suggest you follow up again your salary, if the company still refuses to release your salary, you may file monetary claim at NLRC.
