Arresto Menor

Hi!I hope you could help me with this.Here's the situation:

My husband used to help his father in officiating a basketball league for company A. After quite some time, his father received a partial payment from company A for that said officiating contract. After receiving the partial payment, his father run away with the money. Company A filed a civil case against my husband and his father because of this.

We admit that what my father-in-law did was wrong but
1.do they have the right to include my husband in the case?
