First week of March 2012, I learned from my colleagues na lumabas na ang list ng makakareceive ng incentives. My former manager called me and said I won't get the incentives although I qualified for it kasi resigned na daw ako. They said, the client didn't pay them that's why they can't pay for everyone. This company is just being kind daw kaya they'll shoulder the fees but yung active employees lang ang babayaran nila.
Nagreklamo ako sa DOLE kaya lang hanggang usap lang dun. Matigas ang lawyer ng former employer ko na hindi nila ibibigay kasi ung client daw sa US ang responsible sa incentives. Which I don't think is accurate kasi sa roll out ng incentives, walang disclosure dun na kapag hindi sila binayaran ng client eh nde na namin marerecieve ang incentives. Metrics lang ang nasa roll out na pinirmahan ng mga agents. Kung alam kong ganun pala edi sana hindi muna ako nagresign. Besides 5 months delayed bago nila ibinigay ang incentives. And when I tendered my resignation, I even rendered 2-week notice and all those times, walang sinabi sa akin ang Manager ko na hindi ko marerecieve ang incentives because I'm resigning.
So walang nangyari sa usapan sa DOLE kasi hindi naman sila mafoforce ng DOLE na bayaran ako. I filed a case sa NLRC. First meeting, tinanong lang ng arbiter how much ang settlement na gusto ko and instructed the company representative to relay it to his superiors. Second meeting, sinabi lang ng company representative na no amicable settlement. So we're scheduled for the position paper na. Tinanggihan naman ako ng PAO kasi malaki daw sahod ko kahit na inexplain ko na kahit mataas sweldo ko, bread winner naman ako at kulang pa para sa pamilya ko. My questions are:
1. May laban po ba ako?
2. I have read your article na may mga lawyers sa NLRC na pumapayag na pumorsyento na lang pag nanalo na ang kaso. Nasaan po sila? Bakit hindi nila kami nilapitan?
3. Since wala akong budget for a lawyer, kanino po ba ako pwedeng magpatulong sa paggawa ng position paper?
4. Kailangan ko po ba magdala ng lawyer sa pagfile ng position paper?
5. Since this is about sales incentives (I was their regular employee and has a basic pay), will this case fall under offense against article 100 (diminution of benefits)?
