Child Support, Please advice

@Jaslene - Opo. May karapatang humingi ng suporta sa ex mo ang mga ito: (1) IKAW, bilang asawa; (2) mga anak mo. Kapag hindi siya nagbigay, or nagbigay pero kulang, maari mo siyang kasuhan ng Violence against women and children.

prettyice, yes you have the right to ask for support on behalf of your children if they are still minors. You have the following options:

1. Enter into a contract for support of your children (you may include yourself as legal wife but this will depend on the circumstances of your other relationship).

2. File a case for support in the Regional Trial Court.

3. File a criminal case, if your ex husband refuses ro give support to your children.

another question po.. pano po kung cnclaim nya na hindi daw nya mga anak ang anak nmin pra mkatakas sa obligasyon... sya po lhat nkapangakan sa birth cert ng bata..

Nakapirma ba siya sa birth certificate?

Madaming paraan para mapatunayan na siya ang legitimate father.

1. Birth cert.
2. Baptismal.
3. Handwritten acknowledgement.
4. Witnesses.
5. Other evidence.

imo, 25 is still a substantial amount. your better remedy may be to file a civil case for increase of support, and the court might order his agency or employer to give the money to you directly.

AttyLLL is right. This is because support depends on the capacity of the giver and the needs of the receiver.

Under the law, you and your children are entitled to be supported by your husband. There are many ways you can do this:

1. by contractual support.
2. filing a case for support.
3 legal separation.

I always have this curious question in mind. most of the time we are encoutering a mother asking for a child support from the father. which sometimes ends up in a ecomonic abuse case. now let's reverse the situation, what if the child is with the father, can he ask the mother to provide the same? and what case can be filed if she failed to do so????

hingi lang po ako ng advice. im 6mos pregnant now, admitted mistress! alm nmn po ng wife nya na nkabuntis yung asswa nya at my relasyon kmi gang ngayon. nsa abroad po kasi yung wife nya pti yung isang anak nya. dpst mtgal n rin po syang nkaalis kaso nlman ng wife nya n nabuntis ako ng asawa nya kya hindi tinuloy s knya yung petition s knya. ngayon po ngkaayos n sila ulit bg aswa nya tinuloy n po pgkuha s knya, paalis n po sya nextweek at nlaman ko lng po yun sa kaibigan namin. kasi 2 weeks n po kming wlng communication. aalis n lng po sya n hindi sya nkipg usap sakin ngtry po akong kauspin sya pero ayw nya king harapin. ask ko lng po meron po ba kong habol pra lng sa anak ko? mahagarang ko po ba yung pag alis nya?
