Hello everyone/atty,

I would like to ask your opinion regarding my friend's circumstances. She was caught recently in a grocery supermarket shoplifted goods. She cooperated well with the guards on duty who interrogated her. She was brought into their office, and in the end was asked to write a letter addressing the supermarket - it was a letter of apology for her wrongdoing and stated also in the letter that she paid a sum of Php3,000.00 as payment for the penalty charged on her. She was told that it was for the settlement of the incident, and for the company not to file further charges against her.That, if she can't settle the said amount, the company will proceed in filing charges agaist her, and on that moment, she will be brought to jail. She also signed a receipt showing that she paid that amount, and a 'Claim Release' form.

My question is, can the management be aware that she really paid the penalty charge? The guards on duty (surveillance guards inside the premises) told her that she must pay that certain amount, as per the management's decision, - according to them. My friend is doubting if that money will be really given to their office or will just fall into the guards' pockets?
And will the company can still file charges against her? And one thing, she wasn't given her copy of the letter, and the 'claim release' form as well. Please advise. Appreciate all your advise/s.

i recommend that she leaves it be unless she wants to write a letter to the management to confirm her suspicions

Hello atty i just saw this thread and decided to post on it. Need ko po tlga advice nio. I was recently caught shoplifting sa isang sm mall dito sa amin. And un dinala ako together with the saleslady who saw me, isang nakacivilian na lady guard ata un and an escort sa office nila pra kapkapan at interrogate. I am really guilty of the offense and I am willing to make up just to cover up the damages kaso di nila ako pinabayad then pinapirma lang nila ako ng form stating what I did tapos kinunan din nila ng statement ung mga saksi. niransack mga gamit ko at chineck kung anu mga items nakuha ko. then after I signed pinicturan nila ako then sermon. taz pinaalis na ako at binilinan not to go inside the mall anymore. Worried po ako kc pag mgreport sila regrding the incident sa work ko (teacher po ako nkakahiya man po) at baka ipost nila ung pics ko all over the mall at makita ng superior ko at mga magulang at estudyante tyak po mttngal ako sa work. ako pa nmn po ang breadwinner ng family at 4 ang anak ko. Sbi nmn po nung nginterrogate skin di dw nmn nila irereport un or wla mkakaalam not unless magkwento ako. di pa din po ako kampante with the statement.

Nirereport ba po nila ang gnitong cases sa work ng knilang nhuli? Ipopost ba po nila ung pic ko sa buong mall. Mamamatay na po siguro ako pag nangyari un pls advice me what to do Suspect Suspect Crying or Very sad Sad Sad
