Hello po!

May umutang po sa tatay ko, tapos nagpapatunay po rito ay ang isang pinirmahang voucher na naghahalagang P450,000.
Tapos po, as a security nung debtor, binigay po sa tatay ko yung titulo nung lupa.
Pero hindi pa rin po nakakabayad hanggang ngayon yung debtor.
Hanggang sa nalaman na lang nung tatay ko na nagpagawa po yung debtor ng panibagong titulo. Sinabi po na nawala lang yung kanya, samantalang alam naman po nito na nasa tatay ko iyon.

Ano po kaya ang action na pedeng gawin? Adverse Claim? Pede po bang kasuhan ng criminal case? Please tulong naman po o...

maliban ba sa pag abot ng titulo wala na bang ibang nilagdahan ang taong umutang sa tatay mo? sa aking pananaw, maari mo siyang kasuhan ng criminal case na estafa dahil sa panlalamang at kanyang intensyon sa lokohin lang ang tatay mo sa pamamagitan ng pagbibigay ng titulo...eto ang mga elemento ng estafa

Swindling or estafa is punishable under Article 315 of the RPC. There are three ways of committing estafa, viz.: (1) with unfaithfulness or abuse of confidence; (2) by means of false pretenses or fraudulent acts; or (3) through fraudulent means. The three ways of committing estafa may be reduced to two, i.e., (1) by means of abuse of confidence; or (2) by means of deceit.

The elements of estafa in general are the following: (a) that an accused defrauded another by abuse of confidence, or by means of deceit; and (b) that damage and prejudice capable of pecuniary estimation is caused the offended party or third person.
