My dad, a gov't employee, availed a housing loan.

During the time that the house and lot can be used, he decided to have it rented by his sister. Everything is through verbal agreement.

Years passed and late that we realized that his sister was not paying anything. The property got foreclosed(could be on purpose) and transfered to another's name.

Basically, nawalan ng rights yung dad ko. Akala niya, he will have his property after it matures. May habol pa ba siya na kahit ano?

naka receive ba kayo ng any notices from the pag-ibig and the court ( where the extrajudicial foreclosure was filed)?

dapat ilapit niyo ito s abogado. just be mindful of the notices. baka kasi hindi kau nakareceive ng notices, maquestion doon ang due process na requirement bago kau mawalan ng property. ika nga, according to law, no one should be deprived of life, liberty or property without due process of law. be mindful about those notices. if wala kau nareceive, punta ka s pag ibig if based s records nila, sino iyong nakareceive s notices at ano dates. get hold of some copies doon s records nila. icomplete mo iyon.

punta ka din s court kung saan na file at nagforeclose s property niyo. get hold of copies na naman. after that, you consult your case to a veteran lawyer. (iyong hindi pulpul. iyong magaling s foreclosure)

We got no notice. Ang kwento is yung kapatid na hindi nagbabayad, pinaupahan pa sa isang john doe. Sila siguro yung nakatanggap nung time na yun kasi sa kanila nakaaddress.

To make long story short, kahit no notice was served before foreclosure, nalaman din na naforeclose na yung property after some time and according to my dad they were trying to get it back kasi nga kahit papano, may nahulog na dati.

Pero bigla na lang yung property/right is awarded dun sa umuupa, meaning sila na ngayon yung naghuhulog at a lower fee.

So wala na talaga? I mean is there any chance na may damages na makukuha or maibalik yung right na maghulog?

Basta yung timeframe na di pa foreclosed at expected na naghuhulog sila is 1994 - 2006. Bale nung time na yan, tumitira sila sa bahay of which the yung rights e sa tatay ko. I'm thinking may karapatan siya sa pera kasi nga kung di sila naghuhulog, e di dapat sa tatay ko nakalaan yun.

Nung tinanong ko naman ang tatay(dito ako masyadong napapamura, kasi parang ang dating, ignorante ang tatay) kung meron silang kontrata. Merun daw. Tinatanong ko kung nasaan yung written contract, ang sagot lang niya e nasa sibling niya pareho.

Sabi ko sa sarili ko, san ka nakatala ng kontrata na yung mismong may-ari walang kopya?

Ang dating tuloy e puro sa tiwala dinaan. May paraan pa kaya given na ang tatay ay tila ignorante sa pinaggagawa niya?

Given that yung tatay ay tila mangmang sa mga bagay na ito, I find no justice why walang pananagutan yung other party. Sila yung tumira na walang bayad kung iisipin, pagkatapos yung tatay ang nagkapenalty sa loan kasi malamang di na talaga siya makakakuha.

Maaasahan ba talaga yung PAO?

Also, may mga kalakaran ba na pwedeng tumulong yung abogado at tumanggap na lang siya ng bayad based on a percentage of damages na makukuha? Let's get real. Sa Pilipinas, ang bagal ng legal system. At pag nasa low end ka ng social class, you're not able to get justice on your side.

before you talk about receiving no notices, pumunta ka s pag ibig at s courts as per instruction. kasi malalaman mo doon sino nakareceive ng notices. kasi based s kwento mo, one sided lang iyon. sa iyo lang na side naririnig ko. determine and know the side of the pag ibig at s court. kung sino ba nakareceive ng mga notices at ano mga significant dates.

after you have done that, punta ka s lawyer , preferably hindi taga PAO.


wag ka dito mag asa dito s forum na ito. opinion lang ito. parang kumbaga, bigyan ka lang ng idea, tapos ikaw na ang bahala s iba. . pumunta ka talaga s lawyer in personal.

Ang di po kasi namin alam e yung kalakaran ng mga abogado. Like kelangan ba may bayad kaagad? Or napaguusapan ba na pursyento ng kung anung damages ang kanyang makukuha.

Atsaka, ang ganitong tipong kaso, worth it ba habulin. Like may statistics ba na nananalo to? Will this take 5, 10, 15, 20 years?

Also, may timeframe po ba ang ganitong kaso? Like if for example na yung date of incidence is 10 years ago, wala ng mahahabol?

How many years(least possible) is needed to be a member of the bar given you finished a certain course(Math)
