Atty Gud am.

Do you have to admit guilt first before applying for probation? or do you need to be convicted first then the probation application would follow?

What are some of the parameters in granting probation. thanks atty!

1st timer, punishment not more than 6 years, convicted, did not appeal or withdrew it. no need to plead guilty.

Would entering a guilty plea right in the very beginning affect the judge's call on granting probation? Just to show remorse

the Judge would only accept the application for bail if the penalty imposed is 6 years and below, it doesn't matter how were you convicted, either by pleading guilty or after a full blown trial...

upon a finding that the same was filed within the reglementary period, the same shall be given due course, the Judge then, would send the application for probation at the PPO who shall investigate if you are qualified or not under existing guidelines, thereafter, the Probation Officer would make the necessary report and recommendation unto the Judge on whether or not the application should be granted or denied...

Thank you for the explanation sir.

There's one item that still confuses me a bit: "probation shall be denied if granting it would lessen the gravity of the crime". When would this apply kaya?
