Financial Support of an Illegitimate Child

Is it right that a mother of the child demands a financial support from the father even they're not married and the family name of the child was followed with his father's family name? If filed in court, who's discretion will be honored?

Is it lawful that the custody is only granted to his mother ?

if they are not married, the mother has no right to support, but the child does. only the mother has right to custody

Art. 201. The amount of support, in the cases referred to in Articles 195 and 196, shall be in proportion to the resources or means of the giver and to the necessities of the recipient.

Send him a demand letter to increase his support. Make an actual computation of your child’s expenses and divided into two (your share and his share).

1)sa situation ko magkano po ba ang dapat kong hingiin na allowance ng bata..
2) May karapatan po ba ang illegitimate child sa assets/ properties ng father ng baby ko..
3)dahil american citizen ang baby ko pwede ba ko humingi ng tulong sa embassy?? anong tulong ang pwede kong hingiin sa kanila??
4)Nagbibigay va ang american government ng financial support pra sa mga american citizen na minor dito sa pinas..

1.There is no actual amount set by law (in Philippines). In my opinion 20k per month is fairly enough for your child. But since your child is a US citizen, perhaps you can ask the US embassy for assistance.

3.Yes. child support from the father.

Just prove first the filiation of the child. Once proven the father has the obligation to provide support.

He said he will give financial support but he cant sign the Birth certificate because he is still married. he keeps on saying na pwede malaman ng legal wife nya. You still have to prove filiation. Although in my opinion the proof is sufficient to prove that he is the father. File a case for violation of RA 9262 on the ground of economic abuse.

Hi, I'd want to ask if I can demand for financial support from the father of my child. My son is already 7 years old, ngayon lang kasi, gipit na gipit talaga. I posted somehow a detailed story in another thread. He didn't sign the birth certificate, and my son is following my family name. What can I do? and what should I do? What are the evidences that I need to present? There's also some abuse involved, he and his mom giving unnecessary talks to my son which I think made him feel unloved and unwanted.

Nung ngbubuntis po ako hanggang manganakk,wala po akong natanggap na suporta galing sknya, nung 3mos na po ang baby ko, nirequire ko na sya na magbigay kahit pambayad sa yaya, nagbigay naman po sya (2k/month) at ngayon po,na married na sya, naging on and off na po yng pagbigay nya at tluyan na nga nastop kaya dumating na sa point na ngfile na ko ng case, umattend po sya nung 1st hearing sa fiscal, pero ung mga sumunod na po, hindi na sya nakattend,ang sabi po ng fiscal,wait nlng ng resolution, if ever po ba na mareceive ko na ang resolution,ano na po ang next dun?
1.ma iisuehan po ba sya ng warrant?

2.possible po ba na mapakulong ko sya pag napatunayan na may probable cause sa sinampa kong case sknya? hindi rin po kasi sya nagpasa ng counter affidavit nya.

xkalyx, if the father refuses to acknowledge that he is the father and won't give support, the legal remedy will be to send a demand letter and then file a complaint in court for acknowledgment and support

Minsan po nagbibigay sya pero di sapat para sa pangangailangan ng bata. Magbigay man sapilitan pa. Minsan po nagbigay siya ng 1500 at sinabi niyang tipirin ko daw yun kasi pang isang buwan na po yun.
ngayon po may iba nanaman syan nabuntis at bagong panganak palang po.
