good day atty.!
ask ko lang po kung pwede ko mabisita yung anak ko sa ex wife ko?kasi since last year nag iba na ng number ung ex wife ko then hindi nya na pinapakausap or pinapabisita yung son namin..in addition att.,maeenforce ko ba yung right ko bumisita sa bata kahit hindi me nakakasusteno sa kanya.sa ngayon po kasi wala akong trabaho and since hindi pa natatapos yung vawc case na sinampa nya sakin hindi ako makakuha ng regular na job kasi halos lahat nagrerequire ng nbi clearance.
Tungkol din po sa kaso namin,hindi po siya umaattend ng hearing pati yung mediation na sinet.ano po yung chance attorney na mapabilis yung kaso ng madismiss yung case at maclear na yung pangalan ko at makahanap ng trabaho at masustentuhan ko regulary yung anak ko?maraming salamat po!

moderator

a charge of vawc does not preclude your from exercising visitation rights, but if she refuses, you'll have to file a case to enforce your rights.

wait till mediation is over then a few hearings that no witness is presented. after which you can ask for dismissal. but if it is provisional dismissal only, then you will get clearance 1-2 years after

thank u atty. sa reply.pano po yung provisional dismissal?bale kasi atty. nung last na nag usap kami ng ex wife ko nagdemand sya sakin ng pera para hndi nya na ituloy yung kaso..so noon po alam ko na hindi nya nga finile since nagbigay naman ako sa kanya ng malaking amount,pero last year nga po nung ngrenew ako ng nbi ko dahil magaaply me ng work nakita ko na nakalagay nga dun yung case ko at hindi daw mabubura hanggang hindi dismiss.pwede ko po ba sabihin yun sa judge kahit verbal lang yung pag uusap namin?tapos na sakin pa yung deposit slip ng banko na pinagdeposituhan ko under her name?ayaw nya na ho talaga makipagcooperate,last na sinabi nya is wala na syang pakialam sakin.bahala na daw ako kung pano matatapos yung kaso at she's moving on na din daw and ayaw nya na magkaroon pa ng kaugnayan sakin.

moderator

your wife has to execute an affidavit of desistance before the prosecutor handling the case, or you file bail and attend the hearings. if your wife does not appear, then case can be dismissed.
