Good day sirs/madam;
Jaime Velasquez, an ordinary electronic technician, is an honorable and dignified man, he worked as an OFW for ten years, from 1986 to 1996, and acquired some properties for his family, including a house and lot in a certain subdivision in quezon province. In 2001, his brother Alejandro Velasquez, also an electronics technician, borrowed P50,000.00 to be used in a business that didn't succeed. Since Alejandro can't pay said amount, he borrowed again, without written agreement, and Jaime, kindhearted as he is, pawned his house and lot in the bank for 600,000.00 and give it to Alejandro, the bank issued the two checks in Alejandro's name since he doesn't want to bring cash to manila where he is residing.
Everything seemed fine during the first month of said title in the bank, but on the succeeding months, Alejandro seemed to forget his monthly obligations and left his residence in manila to move in a small village in pampanga and Jaime was left to pay for Alejandro's obligations in the bank. He withdrw his children's savings account amounting to 100,000 to cover up for the penalties etc. He managed to borrow in a credit cooperative a hundred thousand again while Alejandro keeps on promising to pay him and the bank. In the end, Jaime had to sell the house to avoid foreclosure. He lost his family, reputation and his self-esteem.
Year 2009, he met another woman and managed to put up a small electronics shop in Bulacan. Since Alejandro couldn't pay him with his small income in pampanga, Jaime asked Alejandro along with his wife and a 21 yr old son, to join him in his new business so they can help each other but due to some disgreements, Alejandro and his family left bulacan and back to pampanga. He has no money to rent a house so he settled to be a caretaker of a small chapel. A year has passed and Jaime's business do well, and heard the news of his brother's condition. He took them again and provided for evertyhing they need without obligations. He give them jobs in his shop. Early morning of March 19, Alejandro was looking for parts of a treadmill that he is repairing asked Jaime where it is and the argument went hot. Alejandro punched Jaime in the face and tried to slash him with a screw driver.
What can be the legal grounds for suing Alejandro for all wrongdoings he has done to his brother's fate? He successfully taken Jaime's property, isn't that enough for all the favors he gained that he want to take even Jaime's life? Please enlightened us. Thank you.

thanks po for the interest and reply. meron pong certificate from a district hospital. sinecure po namin agad para lang may maihabol kung kinakailangan.

wala napo ba talaga magagawa sa utang niya that caused a lot of damage on the part of jaime? he's suffering depression and sometimes thinking of harming his brother just to get even that will cause another problem. Kindly help us.

as for the loan, it has to be paid or else the bank will be within its rights to foreclose on the house. he can file a case of physical injuries.

to avoid foreclosure, jaime sold the house in 2009 and paid the penalties etc., he used the remaining money to open his electronics business in bulacan. after he opened the business, asked his brother alejandro to join him so alejandro could earn some money and be able to pay jaime and so on..

last april 1, for the update, the brothers faced each other in the office of the barangay captain, and tried to arranged their case but jaime, after all the favors he gave his brother, pursued the case so alejandro would learn his final lesson. the third and last baranggay hearing will be held on april 15..
