Good Day.

Atty, family ko po operator ng jeepneys, mid october 2010 po nung kinuha namin yung 3 units sa pangangalaga ng kapatid ni mama. Yung isang unit po namin pinagpapasa-pasahan ng ibang extra Drivers, so tinanggal po namin ung nga extra kase simula una naman po eh, ung regular driver lang po ang kinoconsider po naming driver ng jeep na yun, at mula nung pinagpapasapasahan po yung jeep, naging sirain.

kagabi po pumunta sa bahay si tita(asawa ng kapatid ni mama na unang nag-alaga ng jeep,), tinatanong po kung tinanggal namin yung nag eextra ng jeep na yun, kase magdedemanda daw ng labor, sabi ko po kay tita, panong magdedemanda eh yung regular driver lang ang considered na driver namin and besides walang application letter sa amin yung extra tapos sabi po ni tita na driver daw nila yun dati kaso tinanggal nila kaya nag eextra nalang sa jeep namin na yun.

pano pag nagdemanda po? ano mas magandang gawin?

Can I ask Atty what would be the best evidence/proof to be use, if ever? Please? Aside from the absence of Application Letter and the allegation of tita that that driver was already not their employee.

without any documents, you can only allege the circumstances. how often did the extra use the jeep
