A child who is illegitimate was born 1981, leaves with the mother's side. What are the child's rights?

-Prior to birth, there was a case filed against the father of a child that almost led to a revocation of professional license.

-No picture taken together with the father and child.

-No financial support given or even visitation made by the father

did the father sign the child's birth certificate? if not, then she has to file a case to establish he is the father.

can this child use the surname of his father if his father already acknowledge him? and his father wants to use his surname of his child?

THANKS..we already have the documents, admission of paternity and affidavit to use the surname of the father. But why did the legal council in manila city hall told us that it is impossible to change his surname because he is already alive before the law? can we file charges against this legal council?
we only want the documents to be sealed by red ribbon. what is our chances in this situation of changing his surname?
