hi,
our company has just signed ang MOU last Jan.9,2012. this is regarding the purchasing of company.
As per our VP said wala daw magbabago sa title and status ng company.All employees lenght of service daw is continue parin.
Ano po ba yung legal process ng pagbebenta ng 1 company?since magkakaron ng bagong may-ari? diba dapat lahat ng regular employees nito ay bayaran?
lahat po kami ay maraming katanungan ka kalagayan ng company namin.at hindi po malinaw ang mga sagot ng nasa itaas..
sana po ay mabigyan nyo kami ng payo...

if length of service is continued, then separation pay is not required.

another question po,
ibig nyo pong sabihin kahit magpalit ng name ang company at still continues yung lenght of service di parin po sila obligado magbayad ng employee?

kung sakali man po na mag back to zero yung lengt of service?pano po ang system ng bayaran nun?100% po ba?
since purchase of company naman po sila hindi naman sila nalugi...

change of name is a bit tricky. if they bought the shares, or just changed name, then tenure continues.

if there was no merger, but let's say a purchase of goodwill, brands and equipment, then the employees can be hired by the new company as new probees, but they can claim separation pay from the previous employer.
