Ako po ang may-ari ng bahay at pinapaalis ko na ang mga tenants ko kasi di sila nkapagbayad ng 4 buwan. Pinabarangay ko na sila pero di sila pumupunta sa hearing. pinagpasyahan ko na ibenta ang ibang gamit na pwede kabayaran ng mga pgkakautang nila. pero nung nagpakita ang tenant ko kahapon nagalit sya na ikinandado ko ang bahay at pinasok ko. may karapatan naman po ako na pumasok di ba? meron po kaming kontrata na nakalagay don after 3mon na di sila nagbabayad ay pwede na sila paalisin at ihold ko mga gamit na pwedeng kabayaran sa pagkakautang nila..tama po ba yon? ngayon, ako ang kinasuhan ng tenant ko na magnanakaw kasi daw may nawawala syang mahalagang bagay sa bahay nya na pagpunta namin nung una na kasama ko ang mga tanod, wla namang gamit na sabi nya..ano po ba ang maaari kong laban sa kasong pagnanakaw na inihain nya sa kin? karapatan ko po bilang may-ari na pasukin ang bahay di ba? i need legal advice asap..salamat po!

It has been held that a stipulation in the Contract of Lease empowering the lessor to take possession of the leased property without need of a court action is a valid stipulation. Thererfore, the lessor can repossess the leased premises without need of a court action. Of course, the lessor cannot use force in doing so. Meaning, if the lessee refuses to vacate, the lessor cannot harm the lessee in order to force him out of the leased premises. The lessor in such case must resort to legal action. The lessor cannot put the law into his hands.

Going now to your case, you can use as a defense the provision in the Lease Contract allowing you to enter the leased premises. You also said that you brought with you some Tanods. Therefore, you can ask the Tanods to testify that you have not taken anything from the leased property.

If you can prove that the lessee has been lying about the lost property, you can also sue him for perjury.
