I blogged about a custody battle involving friends using absolutely no specific references whatsoever. However, I made one of the parents really upset, threatening to sue me for slander. Huh?

I blooged regarding the custody battle of friends, heartbreaking for their daughter. I used absoluately no specifics whatsoever regarding person, place, or date. Father is threatening to sue for slander. How?

Note that the following requisites must concur in order for an imputation to be considered libelous: (a) it must be defamatory; (b) it must be malicious; (c) it must be given publicity; and (d) the victim must be identifiable.

If the father decides to sue you for libel, you have a very good defense because of the absence of the fourth requisite, i.e., the victim must be identifiable.

question po about this topic, i know this is old...eh pano if the blogger made the person identifiable because the latter is bullying the blogger and the blogger wanted the bully to know that blogger is not afraid of bully?

just the same you may still be sued for libel.Instead of taking the law in to your hands y blogging defamatory statement just report the bullying to the proper authorities(school admins if you are a student or HR in case you are an employee) if still the person is bullying you sue him in court for coercion.

I just realized something, parang malabo yung ireport yung bully, saan sya ire report kung hindi naman ito sa school or office?

I think I will have to face her in court na lang, so that I can be heard din, wala naman akong defamatory statements sa mga sinabi ko...thanks pa rin po for entertaining my question...

sayaka, to be sure, i'd recommend you remove your post. derogatory is a matter of opinion.

if you have a real cause against the person, then some other form of action is better.

im not sure about the complaint, but htmls and screen shots can be altered and faked. ive been in this business since 2000.

you posted in the wrong area.

Meron lang akong isang account sa facebook, wherein lahat nang klase ng kaibigan ko,andon lahat. But since April 27,2011, there were 3 accounts made at facebook using my name and the pictures posted were mine. Until now,hindi pa rin nila na delete and the pictures were being bullied.
Ano ang pwede kong gawin? na print ko ang wall ng nasabing accounts pati mga magpi pista nila sa picture ko doon na mga comments.
Pwede ko ba silang kasuhan for doing so? Pinapahiya nila ako thru the messages they posted sa wall ng mga nasabing accounts. Sobrang kabastusan on my part.
Please help! Thank you!

I would argue that the commentators can also be charged with libel if they made defamatory remarks to add to the insulting picture.
