Severance Pay

Good pm po!

I'm a call center agent atty. and as of now my work status is temporary lay off bec my account was pulled out.

I asked our HR manager to find out if I'm entitled to receive a severance pay since I've been with the company for 4 years and he said yes if the company will not be able to find a new account for me. They are trying to assign me on our office in Makati but I refused due to proximity the reason why I'm now temporary lay off.

Is it true that I cant demand for a severance pay since the company is trying to exert effort to find a new account for me and they will still honor my tenure? Will they file a complaint against me if I will refuse to be assigned on a new account and just wait for 30 days so I can demand for a sep pay?

refusal to be reassigned can be seen as insubordination, a valid cause for termination.

My old account was pulled out by the client...Its closed...
Atty what is the best thing to do? I dont want to be assigned in Makati. According to the notice I received if they cant assign me on a new account til Dec 29 they can give me a severance pay. Though I know that there will be an account but due to proximity I'm hoping that I can just demand for my severance pay.

if you're old account was in davao, and now you're being reassigned to makati, then you can complain. but if it was just in metro manila, you can't complain.
