Hi, my husband work in abroad then he meet her mistress there and they go home in phil. without even know me that he's here in the phil. time goes by they having 2 kids, he didn't support us financially for almost 2 yrs, i found out that he married her mistress and i got confuse because how they can get married if im the original and our marriage is still valid? i want to file a adultery and bigamy to my husband. what are the evidence should i produce to make sure that he gonna be on jail and supper the sins he maid to me and to my daughter pls advice me. thank you

you will need the two marriage certificates and your complaint affidavit. you can also file concubinage and ra 9262 for economic abuse.

thank you for the replied, i already got there marriage certificate, i already have a compliant affidavit here in Pampanga for the Violence R.A 9262 i also have affidavit for bigamy, but they said i need to file it to mMkati because there marriage held in Makati, My x husband is working at siguion reyna law firm he is a legal secretary he said he gonna fight,i feel a little bit nervous. do you think he can depend his self although i have there a marriage certificate,senomar of my husband provide by the NSO?Is there possibility that i will lose this case even im a legal wife?

that is correct. it has to be filed in makati if that is where the second marriage was held.

of course he will try to put up a defense. he might deny that he is the same person. but the best defense is to file an annulment of the second marriage.

But how he denied it? i have his senomar.in there marrige certificate same name,mother, father and address but i notice he change his signature and religious.its possible that im gonna lose in this case?

no respondent will just allow himself to be jailed without putting up any defense. of course it is likely that his law firm will assist him. he might say the signature was forged or that he is now a muslim.

you have a very strong case, but no case is ever fool proof.
