can i get nbi clearance?

good day po atty, I just want to ask regarding this matter. You see, I am required to get an NBI clearance since I will be getting a student visa. But I am really worried because last year I was arrested by the NBI because of illegal gambling. Kaso nung dinala po kami ng mga friends ko sa NBI mismo, naareglo po at pinakawalan kami, but still they took our names and our pictures. A month after that, we found out that the case has indeed filed by the NBI (bale, regular filing po ang ginawa) since we received an affidavit to counter the case filed against us. Sa ngayon po, andun pa sa fiscal ang matter at nakapag-counter na po ako. Pero mukhang malabo pong madismiss, at lalabas na daw very soon ang warrant ko po.

tanong ko lang po, pwede pa ba ako kumuha ng NBI clearance kasi di pa naman ako na-issuhan ng warrant, even if it was indeed the agents from NBI na dumakip sa amin?
