Negligence Resulting To Personal Injury?

Noong September 24, 2011 around 3 PM eh naaksidente po ang ate ko dito sa Tomay, La Trinidad, Benguet. Nabunggo po siya ng sasakyan habang papasakay siya ng jeep. Ang sabi nung nakabunggo ay nawalan daw siya ng preno. Naamputate po ang left leg (above knee ang amputation) at may fracture po ang pelvic bone ni ate.

May police blotter po noong September 24, 2011 pero noong September 26, 2011 around 8 AM lang nakunan ng statement ang ate ko para doon sa investigation kasi daw ehhh hindi sila aware na nailipat si ate doon sa Baguio General Hospital from Benguet General Hospital.

Inasikaso po ng kuya ko pero w/n 3 months pa daw maaaprubahan ang kaso kasi dapat daw w/n 24 hours yung investigation. Ano po ba ang magandang gawin dito? Yung side ng nakabangga po ang gumagastos ng bills sa hospital. Dapat po bang gumawa pa ng written agreement with the side nung nakaaksidente para at least may assurance na makukuha kung ano mang damages ang dapat makuha? Ano po bang mga claims or damages na dapat makuha?

in settlements, anything goes. you can ask for millions, but they may just decline. i recommend you do not enter into a settlement until all the expenses are sure. make sure your sister is ok first.

in the meantime, make sure you have complete evidence. police report, photographs, contact details of witnesses,medico-legal report.
