hi guys. I am a government employee and I work at the City Hall. I perform a clerical job at the office. When Christmas season nears, many constituents of our city give me gifts like fundador, ham and other customary christmas stuffs. I just receive the gifts because anyway, Im not doing the gift-givers any favor in exchange, and it's Christmas you know.. It is a time for love and sharing. My question now is that, did I violate any law? My officemate said that I did but I think he's just jelous because he did not receive any gift Razz

Lando, as a government employee you are governed by the Code of Ethical Standards for Government Officials. That law prescribes certain acts and transactions which are prohibited, among which is accepting or receiving gifts, thus:

"public officials and employees shall not solicit or accept, directly or indirectly, any gift, gratuity, favor, entertainment, loan or anything of monetary value from any person in the course of their official duties or in connection with any operation being regulated by, or any transaction which may be affected by the functions of their office."

wow. Is that so? thanks for the reply. too bad for me. but I dont do any favor in exchange. when the spirit of christmas is in the air, I cant refuse to accept gifts

Tell them to give the gift sa bahay and kung relative or kaibigan mo naman yung nagbigay..I see no reason not to accept it..basta moderate gifts lang at HINDI sa opisina ninyo dadalahin dahil masagwa at unethical talga yan kung tatanggap ka ng regalo sa opisina... Normal lang sa isang tao ang makatanggap ng regalo tuwing may okasyon. Public officers has a private life too just like any other individual.....kung koste, bahay at lupa, alahas, plane tickets to HK..ibang usapan yan...hindi na nautral or ordinary yang ganyan klase ng regalo...
