gudday, isa po akong ofw my asawa at 3 anak i decided n maki pag hiwalay s asawa ko s maraming dahilan. gusto po nyang kunin ang panganay kong anak n mag 8 yrs. old possible po ba at my karapatan po b sya na makuha ito khit hindi kami kasal? 2 years ago naipa transper ko ang apelyido ng tatay nya sa anak ko. ano po ba ang dapat kong gawin s bagay n ito? maraming salamat po...

only the mother has the right to custody, but you have to come back here and exercise it personally. if he refuses, you can petition the court or file a case against him for depriving you of custody. but note, you cannot just leave the children with a custodian.
