Arresto Menor

A foreign student of legal age, studying in Philippines had a relation with a married man

She's now pregnant with this Filipino married man.

The question is

Will it be a ground to cancel her student visa?

not automatically. it has to be shown that her acts make her an undesirable alien. my thinking it will not be likely her visa will be cancelled unless she is living together with the man

If the father accepted and put his signature in the birth certificate of the child,

Will there be a case that can be filed against the parents?

What will be the nationality of the child?

ang number 1 batayan kasi ng student visa ay kung may kakayanan ka suportahan ang sarili mo sa iyong pag aaral...at may enough fund ka para sa iyong kukunin course..as long as kaya mo suportahan sarili mo....walang rason para mapabalik ka sa country kung saan ka galing..sa problemang nabuntis sya ng married man i don't think na mawawalan sya ng visa not unless may magsampa ng kaso sa foreign student at may magpapatunay na may karelasyon sya na lalake na may pamilya...

pasensya na opinyon ko lng ito, dahil may pinsan ako kinasuhan ng ganyan sa ibang bansa pero ang kinoconsider ng embahada sa visa nya as student visa ay ang kakayanan nya masuportahan ang sarili nya sa pag-aaral at enough fund to support herself.

1) acknowledging the child by itself is not a crime. if they are living together, the wife can file a case of concubinage

2) the child will be a filipino because his mother is a filipino. it is possible that it will have another citizenship depending on the laws of citizenship of the father.

Hi attyLLL,

Ask ko lang kung mag file ng case ang wife for concubinage, di ba need mo i-prove kung talagang magkasama sila...kung pupuntahan mo sa bahay pwede ba makasuhan ang wife hindi ba magiging tresspassing?

ano ang maaring ikaso sa wife kung sakaling sugurin sila sa bahay o gumawa ng dahas para mapatunayan lang na may relasyon sila?

- Whats the definition of "living together". If the father still living with the legal family and at the same time visits the house of the foreign mistress once or twice a week, is it considered as living together?



- Atty. the mother is a foreigner and the father is the Filipino. Thanks.

What if visiting means staying in the house for 2 days and sleeping with the girl?

Bringing the baby into the mall with the mother could be "presenting in public as couple"?

If the the baby was recognized by his Filipino father, signed his birth certificate, give all the supports the mother and child need. But since the mother is temporary alien living in Philippines, will the mother bring the child to her home country after the temporary visa expires? Or the baby can give the mother a reason to stay longer in Philippines?
