SYSTEM OF REGISTRATION FOR UNREGISTERED LANDS

• System of registration for unregistered land under the Torrens System (ACT 3344)

• Before: covers voluntary dealings, now includes involuntary dealings

• Effect if prospective; binds 3rd persons after registration but yields to better rights of 3rd person prior to registration (limited effect to 3rd parties)

• Reason: no strict investigation involved

• Subsequent dealings – also valid if recorded

• ROD keeps day book & a register; index system is also kept

• Procedure:
1. Presentment of instrument dealing in unregistered land

2. If found in order – registered

3. If found defective – registration is refused writing his reason for refusal

Good day po.. Ask ko lang po what are the necessary instruments needed to present aside from Deed of Absolute Sale of Rights, we are Dealing po with Act.3344 po, One of the Heir po sold Us Her Rights on the said Unregistered Land. And Deed of Absolute Sale of Rights po says that We Agree to Register it Under Act.3344 the problem po was that this took place last 1972 pa po and it was just today that we are starting to prepare things to Register. Any advise po? Yun pong Registration will also be in RD, right? What other documents po yung kakailanganin namin? Maraming Salamat po.. Good day and God Bless! Need ur advise po,Thanks!

REPLY: LAND REGISTERED IN THE NAME OF THE DECEASED PERSON CAN NOT BE ALIENATED OR TRANSFERED IN THE NAME OF THE HEIRS OR ANY PERSONS UNLESS SUCH PROPERTY IS EXTRA-JUDICIALLY OR JUDICIALLY SETTLED, WHICHEVER IS APPLICABLE. THEREFORE, AN INSTRUMENT EXECUTED BY ONE OF THE HEIRS CAN NOT BE REGISTERED.THE CORRECT INSTRUMENT IS "EXTRA-JUDICIAL SETTLEMENT OF ESTATE WITH SALE", SUBJECT HOWEVER TO THE FOLLOWING REQUIREMENTS:

1. EXTRA-JUDICIAL SETTLEMENT OF ESTATE WITH SALE DULY NOTARIZED
2. PUBLICATION
3. PAYMENT OF ESTATE/INHERITANCE TAX AND DOC. STAMP AT THE BIR, THEN WAIT FOR "CAR" OR "CERTIFICATE AUTHORIZING REGISTRATION
4. SECURE DAR CLEARANCE IF AGRI-LAND OR CERTIFICATE OF IMPROVEMENT/NO IMPROVEMENT IF RES./COMMERCIAL LAND
5. PAY THE REQUIRED TRANSFER TAX FROM PROVL TREAS. OFFICE
6. SECURE CERTIFICATE OF REALTY TAX PAYMENT FROM MUN. TREAS. OFFICE
7. SUBMIT DOCS IN (1) TO (6) TO THE R. DEEDS FOR REGISTRATION UNDER PD 1529

REPLY: LOST "NARRATIVE TECHNICAL DESCRIPTION OR NTD" OF LOT PREVIOUSLY APPROVED BY THE BUREAU OF LAND OR LRA CAN BE APPLIED FOR ITS RE-ISSUANCE SUBJECT TO THE FOLLOWING REQUIREMENTS:

1. AFFIDAVIT OF LOSS
2. CERTIFIED COPY TITLE COVERING THE LOT SUBJECT FOR REQUEST OF NTD
3. CERTIFICATION FROM R.DEEDS THAT THE TITLE TO THE SUBJECT LOT HAS NOT BEEN ISSUED
4. LETTER REQUEST TO THE DIRECTOR OF THE BUREAU OF LAND OR LRA REQUESTING FOR RE-ISSUANCE OF NTD AND CADASTRAL MAP

good day po ask ko po sana itong problema namin sa lupa...bale po may agricultural land po ang pamilya namin,common po yon,bale po yong lolo ko ang nakapangalan na administrator sa mga tax declaration,kahapon lang po kumuha ako ng copy ng tax declaration sa munisipyo at may owner na,nakapangalan sa kapatid ng lolo ko,at nakalagay sa baba ng papel na revised to restore,pinalagyan nila ng pangalan ng owner na wala alam ang mga ibang heirs,ano po ang dapat kung gawin?ibig po bang sabihin yung ginawa nila ay pwede na nilang ipatitulo sa pangalan nila?sana po matulungan niyo po ako kung anong pwedeng gawin?
