Libel on facebook

meron po akong kaibigan at ngkaroon po sila ng discussion sa isang post sa facebook. nagkabatuhan po ng masasakit na salita at ang kabilang panig sasampahan daw ng kaso ang kaibigan ko ng libel. tanong lng po ng kaibigan ko kng kaya po bang depensahan ang kaso kng totoo naman po ang mga sinabi nya sa facebook na sinasabi ng kabilang panig na paninira?

marami nman po ang nakakaalam at susuporta na totoo nman po ang sinasabi ng kaibigan ko at aminado nman po kmi na inunahan nya ng pagsasampa ng kaso pra mapagtakpan ang mga kasinungalingan nya.

sinabihan at tinatakot pa po xa na P200k ang kabayaran at 6 months na pagkakakulong nito... salamat po

libel can prosper even if the defamatory remark is true.

Good Morning Po! May i ask how can i file a case with a person working abroad for posting offensive words and threatening my brother in his facebook wall? and what would be the penalty for his action? i already save his posted words in case he will deny it. The posted words was "Putang Ina mo! Bantay ka lang pag uwi ko!"

1. "counter affidavit"how can i do that..?
2. if ever i admit the case what are the possible scenario that i will encounter?
3. will i have a record in NBI?
4. will i ever be put into jail bec. ryt now im pregnant?

And also is it possible for her to file a complaint against me in their area? what i mean is in Mandaluyong City?Bec.the conversation was done tru internet (Facebook).

a bgy hearing is not necessary because you don't live in the same city.

read her allegations in the complaint and answer what are not true or exaggerated. you should focus on preparing and filing your complaint affidavit on the date scheduled by the fiscal.
