Good am.Year 2009 ng nagoperate ako ng computer shop. I loaned 5 computers sa isang appliance store. I initially paid the downpayment and i issued pdc for the balances. Yung bzness partner ko ang naging co-maker ko.Unfortunately, after a few mos, my husband who has been suffering from spinal problems, was also detected to have brain cysts. He was in and out of the hosp. It affected my business until nagclosed na in span of 1 year. Hindi ako nakabayad sa appliance store. I had no choice but to sell the computers para mailabas ko sa hosp ang asawa ko. Now his doctors require him to undergo Bio therapy every 6 wks which costs us 42k each session. Im only seeking help fr pcso and other charitable inst. Alam ng appliance store ang sitwasyon ko and told them na singilin yun co maker ko who owe us a lot of money too. nagkaroon na sila ng areement but she failed to pay. Nagpadala sila ng registered mail,yun anak ko na 15y/o ang nagreceive at nagsign.They still filed estafa case against me.May 1st hearing na kami sa June 14, 2011. I have no idea on what to do. Wala po akong abugado and wala din po akong maibabayad.Im begging pls na sana may tumulong po sa akin magbigay ng legal advises.

ride it out until you have money. go to the hearing, ask for time to prepare your counter affidavit. argue whatever you can to buy time until you are in a position to settle.

it's no issue that that it was your son who signed for the subpoena.

estafa can prosper because you issued bounced checks for goods. argue that you did not intend to defraud. hopefully the prosecutor will only file bouncing check, but not estafa.

thank u so much for your response sir...kung tanungin po nila yun computers (i was forced to sell them para po makalabas sa hosp ang mister ko), will i say na binenta ko po? nakapaghulog din naman po ako sa knila kahit pano..meron din po check na nag good and yun iba nireplaced ko ng cash payment.
