Sir good day po may itatanon lang po ako sinampahan po kasi ang mother ko ng estafa case at falsification of document itatanong ko lang po kung criminal case po ba ito... at may mga sopeana po na dumatin dito sa bahay pero lahat po un pinupuntahan po ng mother ko itatanong ko lang po kung magkakaroon po ba sya ng arrest of warrant dahil po ba dito?? kahit po ba pinupuntahan nya po ang mga cases magkakaroon pa po ba sya ng warrant of arrest??

estafa case and falsification of documents are criminal cases. if you ignore it warrant for the arrest of your mom may be issued.

what happen to the subpoena? what is the status of the case? as you said your mom has attended all the subpoena issued to her

atty. meron lang po sana ako gustong malaman. possible po ba na meron mag file ng case against me ng hindi ko nalalaman? and will that reflect po kapag kumuha ako ng nbi clearance? kase ang pagkakaalam ko po, kapag nag file ng case, dapat makatanggap ng subpoena ang kinakasuhan at bibigyan sya ng time para sumagot sa subpoena di po ba?


gusto ko po sana itanong kung possible po ba na meron mag file ng kaso against me ng hindi ko nalalaman or hindi man lang po ako makakatanggap ng subpoena? kase po 1st time ko nagkahit last month sa nbi, tinanong lang naman po ako kung bakit hindi daw po ako nag attend sa hearing, nagulat po ako dahil wala naman akong alam na kaso ko. ininterview po ako kung san ako pinanganak at saan po ako nagstay my whole life. sa malabon po kase ung case na sinasabi nyang na file, eh from pampanga po ako. and ung spelling po ng last name na may kaso, iba sa spelling ng last name ko. velasquez po ung may kaso, velasques naman po ako. tapos pinag sign lang po ako ng affidavit na nag deny ako na ako yun, and ung reasons kung bakit ko po masasabing hindi ako ung taong yun. tapos binigay na po ung clearance ko. pero nagwoworry lang po ako, kase first time nangyare sakin yun.

in the event that a case was filed against you, a subpoena will be issued on the known address that the complainant entered into in his filing of the case. there are instances that a case filed and subpoena was not received by the respondent because the address given was wrong or the respondent was no longer in his last knwon address.

in your case, i assume that it was just a name-sake wherein your name was on the list of the NBI that has the same surname or same sounding name. with the affidavit of denial submitted you just have to request the delition of your name in the quality control list of the NBI so that this issue will be corrected.

What if yung complainant nag issue ng subpoena, pero wala ako dun sa address na nakaregister, but aware po sila kung saan ako makikita, obligado po ba sila dalhin yung subpoena kung saan ako nakastay?

no, they are not obligated. and if you do not appear at the prosecutor's office, the case can be resolved just based on their evidence and statements.

paano po pwede malaman kung may nasama ng case? kailangan po bang icheck sa court? but i'm not sure san sila nagfile ng case.

magfifile lang po ba sila ng case kung san nangyari ang incident or pwede rin direct sa manila since dun ang head office even and incident dito sa .

san po ba possible na magfile ng case ang complainant, sa area kung saan nagyari or possible rin sa Manila or Regional Trial Court? If I'm not receiving any subpoena since I'm staying on the other house, how can I know I they already filed a complain against me?

I don't know where to check if there is already a case.

And is it possible that my neighbor will receive the subpoena if in case I am not around.

I worked in a electric company before, I and the teller issued a falsified receipts and delete the bills in the program so we can have the money on our own. While i was still working there, kaunti lang po yung nakuha namin na pera, around 30k lang yun. Umalis na po ako dun after 4 mos., but the teller continue doing it. Now, kinasuhan po siya ng company kasi bumalik yung mga bills nung nagreprogram at maraming nagreklamo sa mga tao. Kaya kinasuhan yung teller. Tinuro ako ng teller na ako daw yung utak ng lahat ng yun. Is there a possibility na kasuhan din ako without telling my side first? Makukulong po ba ko pag nagkataon? Ilang taon po ako makukulong? Ano po ba dapat kong gawin para makalusot sa kaso na to? Please atty i need your help. Thanks.
