fresh period applies after filing a motion for reconsideration. that is not the situation here.

i would lean towards the rule that appeal is perfected by filing of the notice of appeal.

looks like you got hit with one of the more strict ASGs. the remedy would be to file a Motion for Reconsideration with the RTC then a Petition for Certiorari, or just go through the appeal.

this was straight up, by the book annulment? if so, then you should win in the appeal.
