gud day atty. i just need legal advice regarding yung lessor namin nag file ng ejectment case sa brgy. regarding late lagi yung payment namin which late only for few days tapos nillagyan agad nila ng interest of 7.5% interest from 8,250 yung rent namin nagiging 8,865..which mayron naman kaming 1 month advance and 2 month deposit sa kanila,,,i was asking hindi ba pwede namin gamitin yung 1 month advance namin which ibinabalik naman namin with interest pa..sabi ng brgy wla raw sila magagawa kasi ayaw na raw ng lessor kailangan umalis na raw kami...so i ask them regarding sa rent control act which kung ano-ano yung mga grounds para sa ejectment..which paano nag karoon ng breach of contract kasi hindi raw kami nagbabayad eh nagbabayd naman po kami with interest pa pag na late...ano po ba pwede naming gawin...gusto nila 2 months umalis na kami..ano po ba mga rights namin para hindi kami mapaalis...may laban po ba kami regarding sa sinasabi nilang breach of contract? sabi pa nga sa akin ng bgry mayabang daw ako kasi expired na raw yung sinasabi kong rent control act which is republic act 9653...ano po rin ba pwede kong sabihin sa brgy kasi na reset po yung hearing kasi hindi kmi pumayag sa gusto nilang hanggang 2 months na lang kami sa monday po uli yung hearing namin..maraming salamat po..

never mind the bgy if they won't listen to you. they don't have the power to decide who is right anyway.

keep occupying the property and keep paying the rent. no one can make you leave unless there's a court order.

thank you so much but if kung hindi na nila tangapin yung payment namin pwede ko bang ilagay sa bangko yung mga payment namin or is there any legal ways to continue our payment para pagdatig sa court hindi nila pwede i-reason na hindi kami nag babayad ng rental namin..and ask ko lang po legal ba silang mag taas ng rent without business permit i mean yung resibo nila tempo lang pero corporation daw sila...which marami kasing paupahan ito which lagpas 1million a year ang kinikita nila rito mula sa paupahan..is der anyway para mapigilan yung pagtaass..kasi sabi nila kaya wala para hindi raw ipataw sa amin yung taxes nila if ever daw kasi kami ang mag shoulder nun...and ask ko lang kasi kami lang yung pinapatungan nila ng interest yung iba kahit gamitin yung advance nila hindi nila binibigyan ng interest,..is thereany harassment charges pagdating sa mga tenant..thank you so much...God Bless..maraming salamat po atty.

see rent control law how to consign payment to bgy or bank.

That in the case of refusal by the lessor to accept payment of the rent agreed upon, the lessee may either deposit, by way of consignation, the amount in court, or with the city or municipal treasurer, as the case may be, or barangay chairman, or in a bank in the name of and with notice to the lessor, within one (1) month after the refusal of the lessor to accept payment.
