Question? Ano po ba ang "due process sa pag close ng company?"

.. pasensya na po dahil po bago ako sa forum rules ko po na post itong question. Anyways po. I re-post ko na lang po dito.


Good evening po? Meron lang po akong tanong? Isa po kaming maliit na company na meron pong 8 employees. After 2 years ay di po kumita kaya po recently after po ng financial assessment of lossess ay nag decide po na i close na lang po namin yung company.. Magastos po pala mag-sara ng companya.

Para po makatipid, dahil talaga pong lugi.. Nagdecide po ang management na iinform po ang 3 na trainees na me 1-2 months pa lang sa company na i-end na lang po ang training nila with 3-5 days notice. Then yung iba po na regular employees, in-observe po namin yung 30 days na written notice sa kanila at sa DOLE.

Unfortunately po, nag-complain po yung mga trainees na illegal dimissal daw po sila kasi di daw po sila nabigyan ng 30 days notice? Considered po ba na illegal dismissal po yun kahit trainees lang po sila at wala pa silang contract sa company? Bukod pa dun, nag dedemand sila ng 1 month separation pay dahil daw illegally dismissed sila?

Actually po, tinry po namin makipag usap sa mga trainees at nag decide na isama na lang sila sa mga regulars na binigyan namin ng 30 days notice before closure para po di na sila mag complain. Ang problem naman po ay halos di na sila pumapasok. Then we tried po na kausapin sila na marami pa po kaming dapat ayusin para po maayos na masara po yung establishment kaya sana po wag na sila masyado mag absent. Kaso sinabihan po kami ng trainees na mag susumbong ulit sila sa DOLE na yung 30 days notice daw po prior sa closure ng company ay privilage daw nila na mag hanap ng trabaho. Kahit daw di sila pumasok ng isang buwan, dapat daw ay wala daw bawas ang sweldo nila. Ganun po ba iyon talaga? Ang hirap lang po kasi dahil talaga pong wala na pong pera kaya nga po mag-sasara tapos parang ang hirap po ng mga demands po ng mga trainees. Binabayaran na nga po sila tapos di pa po pumapasok? Ganun po ba talaga ang due process prior to closing?

Pasenysa na po kayo kasi medyo bago lang po sa business...

In my opinion, the trainees' claims are absurd and without basis.

They are still considered employed within the 30-day notice period and should still do their tasks. If they don't come to work, their pay should be adjusted accordingly and/or they could be charged with abandonment or declared as AWOL.
