My mother made a bank loan just before she died. After a few months of monthly payments we werent able to continue the payment because we couldnt afford to. we wanted to get back the title from the bank but how? the loan was for 2M but now they fined us with 1.8m so its almost 4m....we cant afford to do that...what can we do at this point? can the bank foreclose our property? shouldnt we be spared of the interest? pls enlighten me....the bank is making it difficult for us...parang lumalabas bahala kayo basta bayaran nyo whatever we compute or sorry kayo....thats how i look at it....we've raised enough money for the loan lang itself but not for the fine..what to do?

they will probably foreclose after which you will have 1 year before they can evict you. during that time, you can pay for the loan.

keep negotiating with the bank. most will eventually relent and allow some kind of settlement.

there are some things you can consider to try to stop the bank, but none of them fool proof. one of them is to file a judicial settlement of estate to tie up the property in court proceedings.

another, though I'm not sure if it can work, is for the estate of your mother to file for rehabilitation so that payments can be suspended.

u mean the bank can foreclose the property even if the loan amount is just 1/4 their appraisal value? (that's not even the actual value)

as long as the loan is not paid, yes. the low amount means it will be easier to redeem
