yes, oral defamation can be basis for criminal or civil complaint for damages.

Salamat po Atty LLL, sana po meron kayong marefer na lawyer para sa akin, I wanted to pursue this case dahil hindi lang po ito para sa pagkatao at reputation ko kundi para din po sa mga taong nagtiwala at bumoto sa akin para sa position na meron ako ngayon.

file your complaint first at the bgy. lawyers are not allowed there yet. only after no settlement is reached can you file a complaint affidavit at the prosecutor's office.

Hi AttyLLL, she pleaded guilty in the barangay hearing today saying that she really said na kabit lang ako, but she says that she only heard it from somebody. Sinabi nya yun ang sinabi sa kanya kaya daw yun ang impression nya sa akin, kung gusto ko daw hanapin ko daw po ang nagsabi nun sa kanya. Enough na po ba ang pag plea nya ng guilty sa barangay on the basis of hersay?

remember that the bgy is a forum for conciliation. if no amicable settlement is reached, then your next step is to acquire a certificate to file action and file with the prosecutor. the bgy has no power to determine who is right or wrong.

it is not an excuse that she just heard it from someone else.

note that all statements made in the bgy hearings are inadmissible as evidence.

tapos na po ang last hearing namin today at the barangay level, makukuha ko na po yung CFA ko sa monday. maraming salamat po sa inyong mga advise and information. naghahanap po ako ng lawyer na pwedeng humawak ng kasong ito, please email me po at capizenia@yahoo.com. pwede po ba ako magproceeed sa prosecutor without an attorney muna?

if you can prepare your complaint affidavits and the affidavits of your witnesses by yourselves, then that'll be fine. just allege the facts.
