We filed an ejectment complaint at our Barangay against a tenant whose lease contract had expired but wont vacate.
The problem is that the Barangay Captain is close friends said tenant.
More than 5 summons have been issued already but the respondent won't show up before the Lupon.
Instead of issuing a contempt of court, our Barangay Captain kept insisting that we should renew the contract instead, and that "Wala siyang magagawa kundi mag-antay na lang" and that he can't give us CFA bec. the respondent didn't show up.
When we have shown that we have read the Barangay Handbook stating that the respondent is barred from making counterclaims and that we are entitled to file our case to the court, they admitted that we were right. However they resorted to delaying tactics saying that they are either too busy with some seminar or whatnot.
Should we ask the Mayor's office for help instead?
If so, can the Mayor's office issue a CFA?
