Good day!
Isa po akong freelance salesman (automotive parts supply). May naging problema po ako sa isa kong customer sa Cagayan De Oro na hindi na makabayad sa stocks n inorder nya last Feb. 2016 (overdue account na). Ang standard agreement lang sa terms/payment na ibinibigay namin ay 6 months (180days) via PDC (Post Dated Checks), na hanggang ngayon ay hindi sila makapag issue ng checks or cash man lang kahit pakonti-konti . Nag offer na din ako na ireturn na lang yung stocks samin (backloading) pero ayaw pumayag ng may-ari. Wala na dun ang mismong may-ari pero nandoon pa ang nanay nya na siyang kausap ko everytime na nagpupunta ako at sinabi nya mismong sakanya na itinurnover ng anak nya ang kanilang tindahan. Masyado na akong namroblema sa kanila kasi bukod sa bago pa lang ako nagsisimula ay yung total amount ng stocks na 83,166.50 ay sa akin na ibinawas at buwan buwan kong binabayaran sa kumpanyang nirerepresent ko. At hindi pa ganun kalaki ang sales ko monthly kasi nasa period pa lang ako ng pagpapakilala sa customers ko.
Ang tanong ko po ay kung posible ko pa ba ma pull out man lang yung stocks sakanila at maireturn sa kumpanya ko, at sa anong paraan kaya?

that amount shouldn't be charged to you. you can file a complaint at nlrc for illegal deductions, unless you agreed in writing that you would pay for it.

if so, the company should execute a deed of transfer of rights to you that you now have the rights over the collection of the debt

Salamat po.

Pero possible ko pa kaya mapull-out yung items? Iniisip kong lumapit sa munisipyo ng CDO kung sakaling matulungan nila ako,kaya lang hindi ko alam kung paano approach gawin ko.
