Dear Sir/Madam,

Tanong ko lang po kung may paraan pa na di bayaran ang capital gains tax and documentay stamps tax sa deed of assignment? Apat pu kc naging buyer ng lot namin pero nakapangalan pa sa corp. ung title. From 1st buyer ng deed of assignment sa second hanggang 4th buyer.Then ung 4th buyer nagpa transfer na ng title. Nabayaran na namin ang Creditable witholding tax na nakapangalan sa 2nd buyer. Surprised

what you can try to do is ask the corp to issue a new deed of sale. if not, then you're stuck with having to pay the cap gains.

Thank you po atty. for the reply.We already issued a deed of sale for the 4th buyer dahil nga po nagta tranfer na ng title.Pagdating po sa BIR nakita nila na nagkaroon ng deed of assignment from the 1st buyer to the 2nd n the 2nd to the 3rd buyer, then 3rd buyer to the 4th buyer.And finaly gumawa na kami ng deed of sale nakapangalan sa 4th buyer.Pinapabayad ng BIR capital gains and docs. stamps 3times.We already paid the creditable witholding tax na nakapangalan sa 2nd buyer. The corp. does'nt gain anything when we issued deed of assignment.We issue deed of assignment upon request of our clients due to financial problems.The 1st contract that we issued is the contract to sell of 1st buyer then the 1st buyer requested deed of assignment because of financial problems and so forth hanggan sa 4th buyer. then the 4th buyer wanted to transfer the title to her name so finally we issued deed of sale.

ah sorry, you are the owner? you bought the property from the corp, but it was not transferred to your name? in that case, you really have to pay cap gains. doc stamp will depend on your agreement.

argue to the bir that the the first 3 contracts were nullified so the transfers were not done. but to be honest, they do have a right to collect transfer for each time.

Affidavit must be executed by the heir and charges necessary to prevent extrajudicial estate.I a valid support agreement that we have read somewhere deed of absolute sale with a declaration of heirship extra judicial settlement should follow.

Hi po, good day. I just want to ask po. My grand father has a propety sa isang compound, and he promised to give me a part of his lot before I get married. how do I go about transfering the title of that particular part of the lot po kaya? And since it is a gift, kelangan pa po kaya bayadan lahat ng fees like if it was sold po? Thank you very much po!
