Hello,

I would like to ask about my problem regarding BIR. I was a self employed freelancer and I decided to close my “business” and I’m trying to apply as an employee.

Now, I learned that I couldn’t change my RDO while the they are processing my closure of business. it’s been almosr three months since I file closure of business and I really need a full time job now.

Question:
How long does it take to process my closure of business?
how long does it take to change from 1901 to 1902?
Where can I seek legal help if they try to impede me from getting employed because of the long processing?

who is trying to impede you from being employed?

you dont need to change anything to be employed. you dont have to transfer rdos either.

Usually its the employer who will submit the proper documents to BIR to transfer you from your RDO to the RDO servicing the company. Just fill up BIR form 1905 and submit it to your employer.

Would they allow me to transfer while they are processing the closure? I’m just worried and paranoid that there would be conflict between the employer’s requirements and BIRs policy.

@lukekyle Wouldn’t I need to switch from self-employed(1901) to company employed(1902)?

no you can't since your hindi pa closed sa bir yung business technically you will be classified as earning both from business and compensation. just inform your employer. I believe in this case no need to register na (but check with BIR to be sure) Ang disadvantage lang is you won't be qualified under substituted filing, so you have to file your itr yourself

Would it take years before they could closed down the business completely? Ang hassle ng process to be honest.

I’m just confused if its possible to work while this is ongoing since my current RDO is in Manila. and I am planning to transfer to Mandaluyong.

I dont have a background on accounting so everything about BIR is new to me. I badly need to work so I’m bothered that there might be conflicts between BIR policies vs employer’s requirements.

yes, you are allowed to have both compensation and business income at same time. at most your employer will ask for a 2316 but you won't have one because you were self-employed
