My company is under audit of BIR for our 2009 books. The problem is that our documents were lost and damaged during the typhoon Ondoy. What remedy can we do to prove loss and damage of our documents? Can a notarized affidavit of loss do? Please advise. thanks.

you can execute one, but it will depend on the auditor if they will accept that. how did you file an ITR in 2010? the figures must have been based on something.

Thanks for the advise. regarding your question: we have our soft copies but since we are not registered under CAS or looseleaf, we need to present the books which were included in the lost documents together with our receipts and vouchers. We will try to ask the auditor if it will do. By the way, there's no specific format for that affidavit right? Just the normal affidavit of loss? thanks again for your reply.

mclingon,

your affidavit of loss is self-serving. if allowed by the bir, wla na hong ma auaudit niyan. lahat ng ma examine ng bir, mag gawa lang ng affidavit of loss.

there are specific guidelines to follow whenever merong mawla na documents or goods ng company. failure to follow the said procedures, hindi iyan i accept ng bir.

pero if nawala talaga, wala man magawa ang bir. pero , there are other ways para kayo ma audit ng bir. like third party info and others.

the problem lang niyan is if masubpoena kayo, at di i accept ng bir ang affidavit of loss mo. sa korte ka na magpaliwanag niyan in a case that will be filed against you for failure to obey summons.
